1. About these terms

These terms apply to your use of SiyaData, including your account, your SiyaData wallet and any digital services you buy. SiyaData is operated by SIYA EXPRESS LTD, a registered Nigerian company. “We”, “us” and “our” mean SIYA EXPRESS LTD; “you” means the account holder.

By creating an account or using SiyaData, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use SiyaData.

2. Eligibility

  • You must be at least 18 years old and able to enter into a binding agreement.
  • You need a Nigerian mobile number that you control.
  • You may hold only one SiyaData customer account, and you must use it for yourself.

3. Your account

  • The information you give us must be accurate and kept up to date.
  • Your account is personal to you and may not be sold, transferred or shared.
  • You are responsible for activity carried out through your account, except where it results from our own failure.

4. Keeping your account secure

Keep your password, transaction PIN and one-time verification codes private, and do not let anyone else use your account or device. SiyaData will never ask you for your password, PIN or codes.

Contact us immediately if you think someone else has accessed your account or knows your PIN. For your protection, some security changes, such as after account recovery, are paused for a period of time.

5. Transaction PIN

Purchases paid from your wallet must be confirmed with your 4-digit transaction PIN. A purchase confirmed with your correct PIN is treated as authorised by you.

After several incorrect attempts, PIN use is temporarily locked, and repeated lockouts last longer. You can change your PIN, or reset it after confirming your identity, from your account settings.

6. Wallet funding

  • You fund your wallet by bank transfer to a dedicated funding account issued to you through our payment partner. Identity verification is required before a funding account can be issued.
  • Funds are added to your wallet only after our payment partner confirms the transfer, and the amount added is the amount confirmed as received. This may take a short time.
  • Charges made by your own bank for sending a transfer are your responsibility.
  • Your SiyaData wallet is a balance for buying services on SiyaData. It is not a bank account or a savings account, and it does not earn interest.
  • If you need help with your balance, including a request for an unused balance to be returned, contact us. Requests are handled subject to verification and applicable law.

7. Digital-service purchases

  • Before you pay, we show you the service, the recipient and the price. Please check them carefully: a purchase is sent to the recipient number or account you enter.
  • A service delivered to the recipient you entered generally cannot be cancelled or reversed, including where the recipient was entered incorrectly.
  • Services are delivered by mobile networks and other providers and are subject to their own terms, plan rules and validity periods.
  • Services are only available while we offer them. Services marked “Launching Soon” are not yet available.

8. Pricing

Prices are in Nigerian naira and are shown before you confirm a purchase. The price you confirm is the price you pay for that purchase. A price is valid for a short time; if it expires before you confirm, you will be shown the current price again.

Prices can change, for example when our providers change their prices. A change never affects a purchase you have already confirmed.

9. Pending transactions

Sometimes a provider does not confirm a purchase straight away. When this happens, the purchase is shown as pending and the amount is held in your wallet. It is not taken twice.

We check pending purchases with the provider until the outcome is known. Please do not repeat a purchase while it is pending. You can check its status from your transaction history; if it remains pending for an unusually long time, contact us with its reference.

10. Failed transactions and reversals

  • If a purchase fails, the amount held for it is returned to your wallet balance.
  • If a provider later confirms that a service was not delivered and refunds it, we return the amount to your wallet once the refund is confirmed.
  • We may correct errors in your wallet, including amounts added or returned by mistake. We will tell you if we make a correction to your account.

11. Identity verification

Where required, for example before issuing a funding account, we will ask you to verify your identity using your NIN or BVN. You must provide accurate details for yourself only. We may decline or limit a service if verification cannot be completed. See our Privacy Policy for how this information is protected.

12. Third-party providers

SiyaData works with payment partners, banks, mobile networks, digital-service providers, identity verification and messaging providers. We choose them carefully, but we do not control their systems, and their delays or outages can affect when a service is delivered or when funding is confirmed.

13. Prohibited use

You must not use SiyaData to:

  • break any law or regulation, including laws on fraud, money laundering and the financing of terrorism;
  • use funds, cards, bank accounts or identities that are not yours or that you are not authorised to use;
  • attempt to access another person’s account, or interfere with, test or overload our systems without permission;
  • resell services in breach of a provider’s terms, or misuse promotions;
  • give us false or misleading information.

14. Security holds and suspension

To protect you, other customers and SiyaData, we may place a temporary hold on your account, delay or decline a transaction, or suspend your account where we reasonably suspect unauthorised access, fraud, misuse, a breach of these terms, or where the law requires it. Where we can lawfully do so, we will tell you and explain what you need to do.

15. Service availability

We work to keep SiyaData available and reliable, but we cannot guarantee that it will always be available, uninterrupted or error-free. We may need to pause services for maintenance, security or reasons outside our control, and we may change or withdraw services over time.

16. Closing your account

You can ask us to close your account at any time by contacting us. Any pending transactions will be resolved first, and we will discuss any remaining wallet balance with you, subject to verification and applicable law.

We may close an account in line with the section on security holds and suspension, or after giving reasonable notice. We keep transaction records after closure as described in our Privacy Policy.

17. Our responsibility to you

Nothing in these terms limits any rights you have under applicable consumer protection law. To the extent the law allows, we are not responsible for losses caused by events outside our reasonable control, by third-party providers, or by your own failure to keep your account details secure, and our responsibility for a transaction is limited to the amount of that transaction.

18. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant, we will take reasonable steps to let you know before it applies. Continuing to use SiyaData after a change means you accept the updated terms.

19. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria.
